Court dismisses application for independent candidates to contest elections

Wednesday the Western Cape High Court has dismissed a court application brought by the New Nation Movement and others to have independent candidates contest national and provincial elections.
The application invoked Section 19(3)b of the Constitution, which says every adult citizen has the right to stand for public office. This is also in line with remarks previously made by Chief Justice Mogoeng Mogoeng in an earlier matter: My Vote Counts, where he said every adult citizen may stand as an independent candidate at municipal, provincial or national level.
Delivering his judgement, Justice Desai says these remarks are not binding.
